Welcome to oxymed.co.za. Oxymed Africa provides safety products to you on oxymed.co.za subject to the terms set forth herein. When you use any of our services, you are subject to the policies, terms, and conditions applicable to that service. We reserve the right to change any of the information on oxymed.co.za and these terms and conditions at any time. By accessing or otherwise using oxymed.co.za you are indicating your agreement to the terms and conditions contained herein. Please read them carefully.

USE OF Oxymed AFRICA.

Subject to these terms and conditions, Oxymed Africa hereby grants you a limited, revocable, non-exclusive license to access and use the oxymed.co.za website on your computer or mobile device. Except as permitted in this paragraph, you may not reproduce, modify, display or otherwise make commercial use of any content from the Oxymed Africa website unless expressly permitted by Oxymed Africa. Oxymed Africa reserves the right to refuse service to any individual at its sole discretion and without limitation if it believes that a user’s conduct violates applicable laws or is otherwise harmful to oxymed.co.za.

USER REVIEWS, PHOTOS & COMMENTS

Anything posted or otherwise submitted to Oxymed Africa, whether on the oxymed.co.za website or via any form of social media, will be treated as public and non-proprietary. By submitting photographs, comments or other materials to Oxymed Africa, you grant Oxymed Africa a royalty-free, worldwide, perpetual, irrevocable and transferable right to use, copy, distribute, publish and modify such submissions. All such submissions shall automatically become Oxymed Africa’s sole and exclusive property. In addition, when you post photographs, reviews or comments to oxymed.co.za or on any of Oxymed Africa’s social media networks, you also grant us the right to use the name that you submit, if any, in connection with that submission. You further represent and warrant that you own or otherwise control all rights to any content submitted to Oxymed Africa.

INTELLECTUAL PROPERTY RIGHTS

All graphics, images and content on the oxymed.co.za website and blog belong exclusively to Oxymed Africa, or its affiliates. The use of any Oxymed Africa trademarks or service marks without Oxymed Africa’s express written consent is strictly prohibited. You may not use Oxymed Africa’s trademarks or service marks in connection with any product or service that is in any way likely to cause confusion or to disparage or discredit Oxymed Africa. In addition, you may not use any of Oxymed Africa’s trademarks or service marks in meta tags without Oxymed Africa’s explicit prior consent.

ACCEPTANCE OF ORDERS

Please note that the contract (sale) will be concluded only once we (Oxymed Africa) accept the customer order. Dispatch of the order will serve as a confirmation of a customer order in lieu of written confirmation.

INTERNATIONAL ACCESS

Customers who access and use the oxymed.co.za website from outside of the republic of South Africa are responsible for complying with their local laws and regulations.

DISCLAIMER; LIMITATION OF LIABILITY; RISK OF LOSS

To the full extent permissible by applicable law, we disclaim all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose, noninfringement, title, quiet enjoyment, data accuracy and system integration. This site may include inaccuracies, mistakes or typographical errors. We do not warrant that the content will be error free or uninterrupted.

To the maximum extent permitted by law, we will not be liable for any damages of any kind arising from the use of this site, including, but not limited to indirect, incidental, punitive, exemplary, special or consequential damages. To the maximum extent permitted by applicable law, our total liability to you for any damages (regardless of the foundation for the action) shall not exceed in the aggregate the amount of fees actually paid by you to us during the month immediately preceding the act allegedly giving rise to our liability.

The risk of loss and title for items purchased by you pass to you upon our delivery of the items to the carrier.

ERRORS

Accidents happen. In the event that a product is listed incorrectly (eg. price or description) due to a typographical error or other mistake, we reserve the right to refuse or cancel any orders that may have been placed for such a product listed. If your credit card has already been charged for such an erroneous purchase, we shall issue a credit to your card for the full amount of the charge.

APPLICABLE LAW; DISPUTES; REMEDIES

The laws of the republic of South Africa will govern these disclaimers, terms, and conditions. Any dispute relating in any way to your visit to the oxymed.co.za website or products purchased on oxymed.co.za shall be submitted to confidential arbitration in Johannesburg, South Africa. By using the oxymed.co.za website, you hereby consent to, and waive all defences of lack of personal jurisdiction and forum non convenience with respect to venue and jurisdiction in the Republic of South Africa.

By using oxymed.co.za you agree that Oxymed Africa’s remedy at law for any actual or threatened breach of these terms of use would be inadequate. As such, Oxymed Africa shall be entitled to specific performance, injunctive relief, or both, in addition to any damages that we may be entitled to recover, along with our reasonable expenses for any form of dispute resolution, including, without limitation, our attorneys’ fees. No right or remedy of ours shall be exclusive of any other, whether at law or in equity, including without limitation damages injunctive relief, attorneys’ fees and expenses.

SEVERABILITY

If any the provisions in these Terms of Use are deemed invalid or otherwise unenforceable, that condition shall be deemed several and shall not affect the enforceability of the remaining provisions.

RENTAL SERVICE

  1. Rental Agreement: By renting any medical oxygen equipment (including but not limited to Medical Oxygen Concentrators, Oxygen Cylinders, and Portable Oxygen Concentrators) from Oxymed, you agree to be bound by the terms and conditions outlined below.

  2. Eligibility: The rental service is available to individuals who are 18 years of age or older and possess a valid prescription or medical recommendation for the rented equipment.

  3. Rental Duration: The rental period begins on the date of equipment pickup or delivery and continues until the equipment is returned to Oxymed’s designated location.

  4. Rental Fees: Rental fees are based on the agreed-upon rental duration and equipment type. Payment for the rental period is due in advance. Late return of the equipment may incur additional charges.

  5. Equipment Care and Use: The rented equipment should be used solely for its intended purpose, as directed by a qualified healthcare professional. It is the renter’s responsibility to handle the equipment with care, ensuring it remains in good working condition throughout the rental period.

  6. Equipment Returns: The rented equipment must be returned to Oxymed on or before the agreed-upon return date. Late returns may be subject to additional fees. The equipment should be returned in the same condition as when it was received, with normal wear and tear expected.

  7. Damage or Loss: The renter assumes responsibility for any loss, theft, or damage to the rented equipment during the rental period. In the event of damage or loss, the renter may be liable for repair or replacement costs.

  8. Liability: Oxymed shall not be held liable for any injuries, damages, or losses arising from the use or misuse of the rented equipment. The renter acknowledges that they are solely responsible for their own safety and well-being while using the equipment.

  9. Termination: Oxymed reserves the right to terminate the rental agreement at any time if the renter fails to comply with the terms and conditions outlined herein.

  10. Privacy: Personal information provided by the renter will be handled in accordance with Oxymed’s privacy policy.

  11. Governing Law: These terms and conditions shall be governed by and construed in accordance with the laws of South Africa. Any disputes arising from the rental agreement shall be subject to the exclusive jurisdiction of the courts in South Africa.

By proceeding with the rental service, you acknowledge that you have read, understood, and agreed to these terms and conditions.

REPAIR SERVICES

  1. Service Agreement: By availing repair services for medical oxygen equipment (including but not limited to Medical Oxygen Concentrators, Oxygen Cylinders, and Portable Oxygen Concentrators) from Oxymed, you agree to be bound by the terms and conditions outlined below.

  2. Repair Assessment: Oxymed will assess the equipment to determine the scope of repair required and provide an estimate of repair costs. The actual repair costs may vary depending on the extent of damage or additional repairs needed.

  3. Authorization and Payment: Upon receiving the repair estimate, the customer must provide written authorization for the repair work to proceed. Payment for repair services is due upon completion of the repair, unless other arrangements have been agreed upon in advance.

  4. Repair Warranty: Oxymed provides a warranty for the repair work performed, typically covering the repaired components and services provided. The warranty period and coverage details will be communicated to the customer upon completion of the repair.

  5. Equipment Pickup and Delivery: The customer is responsible for delivering the equipment to Oxymed’s designated location for repair. Once the repair is completed, the customer must collect the repaired equipment within a reasonable timeframe. Failure to collect the equipment within a specified period may result in storage charges.

  6. Customer Responsibilities: It is the customer’s responsibility to provide accurate information about the equipment and its condition. The customer must also ensure that the equipment is clean and free from any hazardous substances before submitting it for repair.

  7. Liability: While Oxymed strives to provide quality repair services, it shall not be held liable for any additional damages or malfunctions that may arise during or after the repair process. The customer acknowledges that repair services are performed to the best of Oxymed’s abilities and the ultimate responsibility for the safe use of the repaired equipment lies with the customer.

  8. Termination: Oxymed reserves the right to terminate the repair service agreement if the customer fails to comply with the terms and conditions outlined herein or if repair work is deemed impractical or unfeasible. In such cases, any payments made by the customer will be refunded, excluding any costs incurred for repair assessment.

  9. Privacy: Personal information provided by the customer will be handled in accordance with Oxymed’s privacy policy.

  10. Governing Law: These terms and conditions shall be governed by and construed in accordance with the laws of South Africa. Any disputes arising from the repair service agreement shall be subject to the exclusive jurisdiction of the courts in South Africa.

By availing of the repair services from Oxymed, you acknowledge that you have read, understood, and agreed to these terms and conditions.
